In consideration of the agreement set forth on page one of this contract, and due to the best efforts of the Broker to find a purchaser for the property listed on page one, the Seller hereby grants to the Broker the exclusive right and authority to sell the property, for the agreed upon price, or any other price to which the Seller consents.

The Seller further agrees to furnish to the Broker the names of anyone who may inquire about said property during the continuance of this agreement. If the property is sold by the Seller, by the Broker or by anyone else before the expiration of this agreement, or to anyone with whom the Broker has had negotiations, the Seller agrees to pay to the Broker a fee of professional services at the same rate as the commission listed on page one, that amount being equal to a fixed percentage of the selling price. It is further understood that the Broker's compensation for services rendered in respect to this listing was solely a matter of negotiation between the Seller and the Broker, and was not fixed, controlled, recommended or maintained by any persons not a party to this listing agreement.

If the Seller sells or exchanges the property within 6 months (180 days) of the termination of this agreement to any buyer to whom the Broker has shown the property during the term of this agreement, and provided that the Broker has notified the Seller in writing during the term hereof, or within 30 days after termination of this agreement, that the Broker had shown the property to such buyer, the Seller hereby agrees to pay the Broker the above stated professional fee.

The Seller further agrees to underwrite the cost of preparing the new deed, the cost of filing any mortgage discharge required, the cost of any legal work not noted previously, and any merchant fees (3-5%) associated with the purchase of the property by credit card.

Should a cash money deposit be forfeited, 60% of this deposit shall belong to the Broker, as a fee for professional services, and 40% shall be paid to the Seller, provided, however, that the Broker's share not exceed the amount of the above fee for professional services.

This authorization cannot be revoked except by written agreement of both parties.
