Asking Price: $______________________* THE TIMESHARE VACATION COMPANY, INC., (VACO) agrees to list for sale, by the owner(s), the above-mentioned unit/week, at the stated price/terms noted above. The unit/week will be marketed with conventional marketing tools, including, but not limited to advertising, direct mail, telemarketing, and other marketing programming. In exchange for this marketing effort, VACO requires a $99 listing fee, and a commission of 40% of the selling price. The term of this agreement is one (1) year (automatically renewable annually on the contract anniversary date) from the date of execution, or until the unit/week is sold. VACO may, in its sole discretion abandon any further efforts to sell the above-described property if: VACO learns that the Seller is in arrears on any debt secured by a mortgage deed against the condominium unit; and if the Seller fails to remain current in his/her/its obligation to pay association dues. The owner(s) agree to provide VACO with a copy of any recorded deed and mortgage deed pertaining to the unit/week, along with any other pertinent information required for the timely sale of the unit/week. If the property is subject to financing, the owner(s) will provide to VACO a mortgage discharge or a statement as to the remaining unpaid balance due to the financing company. In addition, the owner(s) agree to allow the unit/week to be shown and will inform the resort's management company that they are requesting full cooperation with the listing broker in order to sell the unit/week. Acceptance of this Exclusive Listing Agreement by VACO is expressly conditioned upon a review of any outstanding financing which encumbers the unit/week, and the full cooperation of the resort's management company.
